Romania is joining the UPC

June 05, 2024

On 31 May 2024, Romania ratified the Agreement on a Unified Patent Court (UPCA) and will officially join the UPC system on 1 September 2024.

The unified patent system is growing for the first time!

Romania is the first member state to ratify the UPCA since it came into force last June, which means it will soon become the 18th Contracting Member State of the UPCA.

From 1st September, any new unitary patents (UPs) will cover Romania as well as the 17 existing UPCA member states, and decisions made in the Unified Patent Court (UPC) will have effect in Romania.

Protection of an existing UP does not expand to include new ratifications, so any existing UPs will not cover Romania.

If you’d like more information about the UPC system, get in touch with the attorney responsible for your patents and we’d be happy to discuss.
