Are Chinese IP Rights enforceable?
March 01, 2011
Whilst the IP system in China is relatively young and not as well developed as in many other countries, a number of rights are available in China.
These include patents which may be obtained via the PCT. Utility models which protect less significant inventions. Registered designs and also registered trade marks. It has been noted that Dyson has recently secured a victory in design infringement proceedings brought in China in relation to its Air Multiplyer™ fan against a Chinese based manufacturer Yongkang Yixuan. It is understood that a number of other design infringements are also under review.
