United States Patent and Trade Mark Office – Process Update

The United States Patent and Trade Mark Office has announced a change in how it will interpret challenged patent claims at the Patent Trial and Appeal Board (PTAB). Challenged patent claims will now be interpreted as what the “person having ordinary skill in the art would understand” instead of “broadest reasonable interpretation”. This change will affect any owner of a US patent whose patent claims are challenged at the PTAB.
